We would like to emphasize that as lawyers, in accordance with Article 13 of the Law on Attorneys and Articles 26-34 of the Code of Attorney Ethics, we are obligated to maintain attorney-client privilege. This obligation applies to everything you have entrusted to us as a client or that we have otherwise learned while representing you as a client, and it extends to our current and former employees.

Interactions to which this Notice applies

Law Firm Bradvica Marić Wahl Cesarec Skerlev d.o.o. (hereinafter: "BMWC") enters into numerous interactions with client, business partners and its own employees on a daily basis. Against this background, it is necessary to distinguish clearly between several types of interactions to which this Notice applies.

Accordingly, this Notice applies only in the following cases:

  • If you access our BMWC office, either as a client or a random passer-by;
  • If you visit our website;
  • If you engage our legal or other services;
  • If you contact or request information from us;
  • If you apply for a job in BMWC.

Who processes your personal data?

With respect to the processing of personal data enlisted in this Notice, Bradvica Marić Wahl Cesarec Skerlev Law Firm, with seat in Zagreb, Miramarska 24, 8. kat, OIB 74439368489, acts as the controller within the meaning of Regulation (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (“GDPR”).

However, in certain cases, BMWC processes personal data on behalf of other service providers (e.g. financial institutions). In that case, another subject is the controller, whereas BMWC is the processor.

Purpose of processing if you are a client (BMWC's client):

  • Legal services
    BMWC can process your personal data based on the Law on Attorneys, issued power of attorney, concluded contract, or decision of a competent authority for the purpose of providing legal assistance, particularly for initiating and conducting proceedings before competent authorities, drafting documents, and providing general representation and legal advice. Therefore, we process your personal data that is necessary for providing legal advice, drafting documents (contracts, wills, statements, etc), representing you in court and other competent institutions, as well as in extrajudicial representation, all with the aim of protecting your rights and legal interests.
    The processing of personal data is based on a contractual legal basis (representation agreement or mandate/power of attorney) under Article 6 (1) (a) and (b) of the GDPR.
    However, considering the specific nature of legal services, the processing of data is also based on Article 6 (1) (d), (e) and (f) of the GDPR.
  • Fulfillment of legal obligations
    We process your personal data in order to fulfill our legal obligations as the dana controller. In certain cases, the office is obligated to process your data in order to comply with legal obligations. Such processing may arise from mandatory legal provisions, such as tax, commercial, anti-money laundering, criminal provisions and similar regulations, therefore, due to state supervision and control, as well as legal obligations to provide data.
    The processing is based on Article 6 (1) (c) of the GDPR.

Automated processing and profiling, as defined in Article 22 of the GDPR, are excluded when providing our legal services.

Purpose of processing if you are a data subject submitting a request to exercise right:: legitimate interest – responding to your request (Article 6 (1) (f) of the GDPR)

Purpose of processing if you are a business partner of BMWC::

  • If you are a business partner of BMWC (individual), BMWC may collect the following personal dana from you: identification information: name, surname, tax identification number, etc., contact information: address, phone number, mobile number, etc., banking details such as: IBAN, bank name, card type, etc.
  • If you are a contact person of a business partner of BMWC (legal entity), BMWC may collect the following personal data from you: identification information: name, surname, etc., contact information: address, phone number, mobile number, etc., information related to your position and department at the business partner's organization.

Purpose of processing personal data: personal data is processed for the purpose of fulfilling rights and obligations under contracts concluded with business partners, particularly for issuing invoices for services rendered. Certain personal data may also be processed i fit is necessary to comply with the legal obligations of the data controller. Personal data may also be processed for the purposes of the data controller's legitimate interests, such as business communication, maintaining records of business partners, and assessing mutual collaboration.


Delivery of your personal data and sources

You are not obligated to provide us with your personal data. However, the provision of personal data is generally necessary for the execution of our legal services or contracts. Therefore, we must inform you that without providing personal data (depending on each individual case), we may not be able to provide you with a comprehensive service of legal advice and representation.

We collect your personal data, in addition to the information you have personally provided, if there is a need for it, exclusively for the purpose of protecting your rights and legal interests as our client and from competent state institutions and third parties.

When collecting data about individuals who are not our clients, we collect them based on your statements or on the basis of legal authority contained in specific laws, or based on access to publicly available registers.


Transfer of your personal data

Depending on the type of your interaction with BMWC, in some exceptional circumstances we will share certain personal data with third parties. Nevertheless, we guarantee that the purpose of the exchange is not to exploit your personal data, but to exchange them in order to provide high quality and timely service, and to comply with relevant legal obligations.

Accordingly, depending on the situation, BMWC will transfer your personal data to the following subjects:

  • authorized employees in Partners Consulting d.o.o.;
  • related individuals with BMWC;
  • our partners that provide us with accounting services;
  • third parties involved in hosting or organising events or seminars;
  • service providers who process personal data either on behalf of BMWC or on separate legal basis, so that we can effectively provide you with requested service or deliver products and packages (e.g. processing of payments, system maintenance, market research, promotions etc.). Such service providers may use or transfer personal data only to the extent and for the purpose as instructed by BMWC;
  • third persons and public authorities (for example, competent state authorities such as the Croatian Pension Insurance Institute and the Croatian Health Insurance Institute, Tax Administration, courts, FINA, Ministry of the Interior, and similar; courts, public notes, court interpreters, experts, opposing parties, and similar; banks, credit and financial institutions, and similar) , (i) in order to comply with relevant laws and by-laws, (ii) to act according to the mandatory instruction or order of public authority, (iii) to prevent and/or report abusive and illegal activities, (iv) in order to protect ourselves from lawsuits and other third-party claims;
  • all other subjects, in respect of which we have received your express consent for exchange of personal data.

Exceptionally, in the case of corporate restructuring/changes of the company BMWC (e.g. merger, separation, etc.) your personal data may be transferred to another legal entity.


Your data, transfer outside the Republic of Croatia and third countries

In case of any potential transfer of personal data outside the Republic of Croatia, we will take necessary measures to protect your personal data, ensuring that the third party receiving your personal data provides an equivalent level of protection as it is in the Republic of Croatia. At any time, you can obtain information from our office regarding the transfer of your personal data outside Croatia and the measures taken to protect it, using the contact details provided below.


How long do we store your data?

The storage period of your personal data will primarily depend on the purpose for which they were collected. In this regard, we guarantee that your data will not be kept longer than necessary to perform the purpose for which it was collected.

Irrespective of the above, in certain cases we will have the legal obligation to keep certain data for a longer period of what is necessary to achieve the purpose of processing. In these cases, personal data will be stored only within the minimum statutory prescribed term. For example, records and documents on daily cash flow, business books and bookkeeping records and other records must be kept for at least 10 years.

Furthermore. Personal data collected within the scope of providing our legal services and legal representation services must be retained for ten years from the final completion of the proceeding, in accordance with Article 11 (2) of the Law on Legal Profession. However, if enforceable judgment, proceedings for extraordinary legal remedies, protection of your rights before the Constitutional Court of the Republic of Croatia and/or the European Court of Human Rights, etc., we will retain your data for an additional ten years from the date when all legal remedies for the protection of your rights and legal interests have been exhausted.

An exception to the above is the documents (wills, contracts, etc.) that you have entrusted to us for safekeeping, and we keep such documents based on your instructions until you retrieve them.

Considering the specificities of legal services, as data controllers we may, in individual cases and depending on specific circumstances, determine a longer retention period for case files in order to protect legitimate and legal interests.

If mandatory legal regulations require a longer retention period, your data will be deleted after the expiration of the additional statutory deadlines.

Personal data that is subject to processing for the purpose of fulfilling the requests of the data subjects and within the scope of our business relationship (business partners) is stored for a period of five years, unless it is necessary for the establishment or defense of legal claims or unless mandatory legal regulations determine a longer retention period. Conclusively, we also inform you that, if all GDPR requirements have been met, you have the right to exercise your GDPR guaranteed rights with respect to your personal data that BMWC processes. Instructions on how to exercise your rights are presented in detail in "Your rights" section.


The security of your personal data

In order to protect your personal data, we have implemented appropriate technical and organizational measures, which we continuously upgrade, to safeguard your personal dana from loss, misuse or unauthorized access.

However, we cannot guarantee complete protection during the transmission of personal data to or from our website. Therefore, it is extremely important that you also take care of the security of your computer, as well as the safe storage and confidentiality of your personal data.


Children

BMWC is fully aware that children are particularly vulnerable group. Therefore, BMWC pays particular attention to the protection of their personal data.

In this respect, BMWC is compliant with provisions of Croatian law regarding the minimum age required for exercising certain legal actions, including provisions on processing of personal data. Among other things, we will seek explicit consent from child’s parents to provide certain services and to access certain parts of our website.


Your rights

For the purpose of effective control over the processing of your personal data, you have numerous rights, which may be exercised directly towards BMWC, if certain statutory conditions are met.

To this end, you have the following rights:

  • The right to ask for information on how BMWC is processing your data. If BMWC processes your personal data, you have the right to request detailed information on the respective processing;
  • Right to access your personal data – to gain a copy of processed data in physical or digital form;
  • Right to rectification of your incorrect or incomplete personal data we possess;
  • Right to ask for deletion of your personal data we possess if the purpose for which they were collected no longer exists, if there is an unlawful processing, if the processing disproportionately infringes upon your protected legitimate interests, or if the processing of data is based on your consent which you have withdrawn (however, it is necessary to consider the possible existence of other reasons that may be contrary to the complete erasure of your personal data, such as storage explicitly determined by law, the existence, establishment, or defense of legal claims, and similar) ;
  • Right to ask for restriction of processing of your personal data (i) if you dispute the accuracy of your personal data, during a period that allows us to verify the accuracy of the data, (ii) if the processing is unlawful, but you have refused deletion and instead request the restriction of data processing, (iii) if your personal data are no longer necessary for the intended purpose, but you still need them for the establishment or defense of legal claims, (iv) if you have objected to the processing of personal data pending the verification of whether the legitimate grounds of the data controller override your reasons) ;
  • Right to ask for your personal information to be transferred to another controller (the data that you have provided to us and that we process based on your consent or for the performance of a contract, and their processing is carried out by automated means, upon your request, we will provide you with the same data in a structed, commonly used and machine-readable format. If technically feasible, we can directly transfer them to another data controller at your request);
  • Right to object to the processing of your personal data in accordance with Article 6 (1) (f) of the GDPR, meaning that if we process your personal data in the public interest or based on the needs of our legitimate interests;
  • Right to withdraw the consent for processing of your personal data at any time, if the processing is based on your consent;

Please note that in order to successfully process your application, you must first identify yourself (e.g. by sending a copy of the ID card). The personal data provided will be used solely for identification purposes and will be deleted immediately upon identification.

Exercising the above rights is completely free of charge. However, in the event that your requests for exercising any of the above rights are manifestly unfounded or excessive (e.g. due to frequent repetitions within a short period of time), we reserve the right, at our own discretion, to (i) charge a reasonable fee for the claim or (ii) to decline to act upon your request.

Changes to Privacy Notice

For the purpose of compliance with GDPR requirements and requirements of other applicable regulations, this Privacy Notice has been updated and amended in May 2018.

Since this Privacy notice probably will be amended in the future, and that new personal data processes will be implemented, it will be necessary to amended or supplement this Privacy Notice. An amended version of the Notice will be uploaded to BMWC website immediately upon its adoption.

In the event that we make significant changes, we will notify you in a timely manner so that you can review the changes and decide whether to continue using BMWC services. Depending on the type of personal data processing, the notice will be uploaded to BMWC web site or we will contact you directly (e.g. by email).
